I agree with all that you said, and I find all those shots at Mr. Nutsack funny but I say if your frustrated as we all are, use that energy to get more votes.
This is one time shot here. Drive them off the fence.

Amazing! There has been, what, a couple thousand messages posted here and you still can't get cards signed? What does that tell you? There isn't enough interest from those who are doing an honest job. The only ones blogging are the ones who need unionnnnnnnnnnn protection because they are worthless and can't or won't do a days work for a days pay. We all know who you are, you're the one sitting behind the mall reading magazines. Read the writing on the wall, stupid. You're wasting your time. Your co-workiers aren't going to protect you.

IT IS VERY SAD:

Many non-union CEs would rather join the Communist Party than join a Labor Union.

They do, however, enjoy things like the Monday - Friday workweek, Paid Vacation, Pension Benefits, Sick Leave, etc.

They never wonder where these good things came from?

The real problem is that Unions are not in the History Books!

I say,

It tells me that things that are good for man-kind don't come easy. Good thing you were not around General George Washington during the revolution because he would of had you shot. Or Jesus Christ bringing us Christianity he would have told you to go to hell.
Me I'm just going to call you the low-life, scum bag, piece of shit union buster that you are. Hope you can spend the money that sissy the Nut Job is paying you in hell shit head.

The Union is coming and we will never give up until it is here.

Hey, Buddy. As a wife of an x CE3 I can tell you he never sits on his ass doing nothing as you have implied. He has busted his butt for NCR for MANY years and look what he's got for it! He's angry because we can't pay our bills now. This is what many years of loyal service has done for him. I'm 100% behind his efforts to get a union. Otherwise little by little everything will be taken away. Do you have to lose your home before you understand this? GO UNION!!!

We need a Union because of people with attitudes like yours. For as long as I can remember WCS has always been NCR's adopted son. Never really good enough. Yet we are the feet on the street. We are the guys that sell NCR. We are the guys and gals that keep the customers coming back. How many customers do we have because of Nutty's and Cheatum's new vision for NCR? Zero, and we will most likley loose quit a few before those two are long gone.

Give them what they are paying for, 30% less for 30% less.

I just wanted to let everyone know the message being sent out to RTSS's.

"RTSS/CORPORATE ASS KISSERS
For safety's sake don't come to the New York Metro Area if there's a strike. you may get hurt. This is not a threat, just a warning."

an anonymous message sent to a cell phone.

Many of you won't care. Many of you would cheer for such an event. If you are one of those people you are a piece of human debris.

The RTSS's are going to be forced to either work or quit. The people who are on strike aren't putting their jobs on the line. Its easy for union people to use the word scabs. Call it whatever you want, we need to feed our families too. Most of the RTSS's are in that position because they either had to take a choice between a 25% pay cut or a 20% pay cut on a salary position. To threaten a man, simply because he is going to be forced to either quit or go to work in NYC while the union is settling a labor dispute is down right evil.

Since some have such hatred for someone trying to feed their families maybe someone can answer a question. If the RTSS scabs don't go into NYC and keep the customer base somewhat happy, how many jobs are going to be lost when Chase and 10 other major accounts go to another vendor? The way I see it, NCR will have to pay an arm and a leg to keep the customer base afloat while the strike goes on, so the Union will still win a decent contract and still not have to lose have their CE's because of losing half the customer base.

For those that are keeping the union message positive I applaud you. You are the guys who deserve to get the money you lost. For the anonymous name callers. I feel sorry for you because the venom in your soul must really cause a miserable life.

Or how about this. Instead of sending threating messages, how about sending idea's to RTSS's on how to get out of going to NYC and crossing the picket lines. Something productive for a change, how about that?

Anyhow, good luck.
Let the name calling resume. LOL

Has the North East gone to a vote yet? If not, do you know when nit will happen?

Anonymous said...

To the above, the vote should take place in a few weeks. We'd like to get a few more cards before going to the NLRB. If you know anyone who hasn't sent in their card, try and get them to.

Anonymous said...

To LOL:
I am one of the NY/NJ CE. I do not agree the person who threats or warns the RTSS who is coming to our area for helping NCR to against us.
It is very difficult to argue "Trying to feed their families". But how can you defense that you are coming here to help NCR to destroy our UNION and force us to have 20-30% paycut??
You are just tryin to help yourself and think you are forced to come. Is there no other choice??
Nobody can predict what is the near outcome for this mess NCR creats, but either we win or loose you,the RTSS, will be NCR's next target then all job will be outsourced like what happened in Canada.
If we,CE and RTSS, do not fight togather, there is no future for you and me in NCR. It just matter of time we will all become looser if we do not stop this now.

Suggestion : We will need envelopes with NCR log on it. Get everyones home address. Mail out letters to their homes. Get information of what we are trying to do and this site. I read all my mail, especially NCR mail that was sent to my residence. Do you think this suggestion might help? The messeging/paging doesn't seem to.

You signed off with LOL (Laughing Out Loud). I hope that you aren't laughing at us, the NYCEs? You cry about having to feed your family but what about our families? Do you want to compare expenses with a NYC worker? You are painting your NYC Mission as Noble and an act of Saving NCR but you are just a Coward. Do you want to "swap" workplaces permanently? You may find yourself in that position (if you do a good job).

Thanks to your crying to NCR, the whole NYCE workforce received a Reprimand from Chris Cheadle (ACS VP) threatening us with Termination for "discouraging" your voyage. First of all, you don't even know who sent you that Text Message. It was probably one of your co-workers who couldn't stand your Selfish Cowardise ways. And Chris Cheadle has committed yet another Ethics Violation by entertaining this conjecture. Secondly, we don't even know who you are. Thirdly, we are confident that you can't do our job!

Your "tidy" little explanation is so flawed that it exposes you as a poor technician as well as a sell-out (no wonder your own buddies are texting you).

The saying in NYC goes that if you can make it here you can make it anywhere so I know that I can survive in your town. Welcome to mine.

MESSAGE FROM BILL NUTTY

Such tension. I'm loving every minute of it. Everything is going my way, I'm so happy. I've ruined so many lives shutting down factory's cutting workers salaries. And we'll have fun, fun, fun now that Nutty is taking the union away.

Well it's the weekend and we are taking the SEA-E-3 out for a test run with all the crew. Mr. Cheatem is coming although he started puking when I told him he had to go. He said it was the thought of the ocean that made him sick. Well I told him he could cut the crews pay and he felt much better. Oh and Chris Walrus will be joining us. We have so much girl talk to catch up on. Like how many CEs we can lay off before we outsource the whole division. She can be such a partier you had to see her at the big NCR bash in Monaco, France right after we cut the CE3 salaries. She was drinking and dancing having a blast while you assholes were bringing home the bad news to your families about your big pay cuts. It was such a fun company paid party. To bad you pesky CE shits weren't invited. Especially since we used your pay cut money to finance it.

It is so much fun being Queen, I mean CEO.

Well again HA RRAY for me and FUCK YOU.

Have a Great Weekend (NOT)

"they either had to take a choice between a 25% pay cut or a 20% pay cut on a salary position."

You mean that if you became a CE2 you would have taken a 25% paycut and as an RTSS you took a 20%, Salary Position paycut?

Fuzzy Math:
$1,000 - 25% = $750 + OT(CE2)
$1,000 -20% = $800 - OT (RTSS)

You sold your soul for $50 / week.

You really are a SCHMUCK!

It isn't that fuzzy. They are now on call 24/7, whether they want to admit it or not. Are they getting AV pay or just doing it for fun? They are expected to work extra hours when needed. Are they getting OT for all those extra hours or doing it for fun? What about the bridge payment, are they getting that? I think not. I will still be making more money than any of the RTSS in my area long after the bridge money is gone. I'm surprised the RTSS don't have to pay dues to the Nut Job to be a member of his SS.

Math Test for an RTSS:

Q. If Johnnie is on 42nd St. and 10th Av. and he must travel to 41st St. and 9th Av. (to fix an ATM),

How would Johnnie go about doing this?

A. Stop at Starbucks on 42nd St. and 9th Av.
Use restroom (wipe shit from your draws)
Continue South for one block.
Give the Junkie a dollar for a "fix".
Grab a "monkey meat sandwich" from Gyro's.
Enter the vestablue (attempt to lock the door behind you)
Ask the Homeless lady to leave the vestibule (10 point Check).
Wipe the vomit from the ATM screen to allow viewing.
Select the proper key from your bag-o-keys (25 lbs of them)
Begin your repair (pray that you don't need a part)

I heard a technician from NewEngland got terminated for talking about his cut in pay and the union? Possibly from Boston? And you still don't think we need a union? Can anybody confirm this??

Anonymous said...

They started RTSS here at 56,000 a year, the very bottom of the band. Right now I'm on track to make between 65 to 70,000 without the bridge. It is not nearly as good as past years but I like sleeping in my own bed, not some cheap hotel in NYC.

Anonymous said...

That is correct, a C.E. from the Boston area was terminated for talking about the pay cuts in some class he was in and managemnet also let him go because "they knew he was active in Union organizing". What a bunch of BS, I hope he gets a good lawyer and sues the crap out of NCR!

Question..Can a company fire you for discussing the union?

Anonymous said...

This is exactly the reason way the union is needed. The company is showing there true colors! Is this really a place that is not employee friendly!!! I am so glad that this movement is starting up. Lets all band together. Pop this pimple on our ass!!! Get things back to where it once was.

To the RTSS who may come to NY/NJ:
First I want make it clear that who post here and made threten messages is not one of us. We are normal human being just like you. It is just not right to even make a gesture to hurt somebody not mention real hurting anybody. Who post that kind of message might be from that Lawyer Firm NCR hired for buster all CE want to unionize.
I do think you would think we will have some kind of welcome party for you when you come to here. But if you come you will be booed for sure.
We would be apperciated to the RTSS refuse to come. And We will very understandable that you come because you are forced to. Maybe very few of you are happy to come to screw up us for some unspeakable reasons.
For those really do not want to ccome but forced to come you may be able to help us a little:
First you should ask NCR pay You MORE for it is very tough job, and demand a round trip of flight tickets every one week if you have to stay. we really do not want you come here for a cheap pay. It is an insult to you an us.
Second. NY/NJ are very big. It is very easy to get lose for anyone who never come here before. You may just run one or two calls a day. I think you have been done an excellent job. You can take it easy to cruise this wonderful city. Take you time to run calls. No need to hurry up.
You know what to do. By doing so, you NCR will not blame you not to help them, and we will be very appreciated to your help too.
Rember we are all in the same side.
Hope you will have a wonderful stay in here.

Anonymous said...

There is just one answer..you ust join the union before they go to the table..This way the company can not expect the RTSSs to come to NY.

Anonymous said...

Look at what this has come to:

Terrible Text Messages, Evil Emails, Bullying & Bickering, Threatening & Terminating, etc.
(it reminds me of political distractions like watching the OJ Trial while the Ecomony was crumbling)

NCR and their Jackson - Lewis Consultants are loving every moment (and fueling the fires).
Chris Cheadle had NO BUSINESS creating this Hostile Environment and HE ALONE is to BLAME
for the chaos that will ensue between now and D-Day.
It all takes away from the "real issue" called 30% LESS. NCR has violated your family and their
livelyhood by taking away the one thing that you need most - MONEY! Don't blame each other!

NEVER FORGET THAT! The only possible unifying factor is a Labor Union. They are Masters at
Mediation, Arbitration and building a Brotherhood of mutual respect for all workers that can
mend our severely fractured unit. Unions represent the workers on all issues of Wages, Hours
and Working Conditions.

REMEMBER: NCR IS TO BLAME, not the workers.

Anonymous said...

The bitter smell of capitalism has brought us to this point; bickering and slandering our co-workers. Upper management should be proud of what they have created here. A once leader of an industry now reduced to this kind of format. Fear, loathing and frustration, is now the new NCR.
I want to thank those on the top for making a marginal job so much worse. The bitterness is so deep it would be hard for the customers not to notice. This company reeks of dissatisfaction and lies. That should be the new logo.

Only the FLS FLT workers in South Jersey and Philadelphia had the guts to vote in the Union a year and a half ago.The NCR Ce's sat on the fence and would not get involved. Now the cuts have come and the conditions have worsened. I hope they make some of you guys go to New York and be Scabs. What is it going to take to get you guys to grow a pair? All you are seeing is more work and less for your families. How do you like the harasment from the RTSS when the Boss is on Vacation? Send in a Card.

Anonymous said...

Hey Philly...
I don't think anyone (I know I didn't) even heard about the union deal a year and half ago. Amazing how things go unheard and unknown.

Thats why it's so important to get the names and address info to a rep. A lot of people must not know what's going on. Send some info to the reps and lets see what happens when CE's get the information. Not all of the CE's can think everything is peachy. I would bet that will increase the card count.

They (fatcats) know we don't see each other and how hard of a battle it is to get info to everyone.
WHAT WE'VE GOT HERE IS FAILURE TO COMMUNICATE...THAT'S THE WAY THEY WANTS IT....

SENT SOME INFO IN TO THE REPS... YOU COULD BE THE DIFFERENCE.

Anonymous said...

Good Morning...If you think things are bad now...dont wait till NYC goes to negoitations. If the company does not see a vote soon.. they will try to go to NYC and try to crush the union to prove a point to the rest of us. So they could say "see..a union cant help you". The one sure way we could combat this is to get our union onboard ASAP. This will cause the company to rethink their game plan. They know that cant win a multi-front war. The company does not have enough guys to handle a job action in several different regions.

If the company succeeds in breaking down this effort, what do you think will happen next..

1st. The RTSS' will have to go.

2nd. They will attack the vacations

3rd. ask us to pay more for medical

4th. once all remaining expense that the company might have, they will thy to sell off the division or outsource us and have all who are willing to work for less, go work for the outsourcer.

AS FAR AS I CAN SEE THIS IS TO RATIFY A UNION NOW!!!

Holy Crap....!!!! This is TEXTBOOK Jackson Lewis, Tactics 101...!!!!!!! ...get someone to send the stike-force personnel any messages that can be construed as a threat- physical or otherwise. Make sure it cannot be actually traced to an individual, just to the area where a strike may take place. Virtually everyone will assume it came from a union member, because that is exactly what they want to believe. This will serve to discredit the Union before it even gets to the negotiating table. Use caution- do NOT let the company that hired you know this, as you need their actual belief. This has proven to be very effective, and precludes the Company from pointing at you if they are charged with illegal conduct by the NLRB. As always- be sure to "suggest" certain actions, but ensure a Company employee actually performs these actions. This will protect you as the consultant.... WOW>>>!!!! I guess it really works...Chris Cheadle fell for it instantly, and sent out the warning....

Most RTSS still consider themselves one of you. That's the point. Without a labor union, though, refusing to go would be a firable offense because we are not represented by a labor union. Although I've heard from someone that a back injury can't be proven hurt or not by a doctor.

I wouldn't mind going to NYC to help out if it were a situation where the area needed help. I do not want to cross a picket line though. I just don't think its right.

In my humble opinion, NCR upper management had decided to create the RTSS job category so that they could have the same people do the same job with no overtime. I can also imagine they knew far in advance that the RTSS's would be deployed along with TM's in case of a strike. I also think that NCR management thought promoting some CE's to RTSS's because these would be the team leaders from the CE ranks who would be helping organizing a union and calling people. I know I was in favor of a union when I got my pay cut paper.

A minority of the people posting on this blog get off by calling people names I think. I believe the movement would get more steam if more of a positive message was conveyed by everyone. I was LOL because I knew how ridiculous some of the responses to my orginal post would be. I wasn't laughing at the labor movement or the threat for bodily harm I received. If you aren't laughing in this life you are crying. You might as well make the most of the situation you are stuck in.

I like your positive attitude in the face of a very troublesome situation. It shows courage and acceptance of responsibility for your own actions.
One thing still puzzles me. Why did you "rat-out" an entire division of TEAMSTERS whose support you will need when you go to NYC during the Strike?
I think that the previous Posters had it right. You are just a Coward and Jackson-Lewis is using you as " Exhibit - A" to convince Chris Cheadle
to engage in TEAMSTER Bashing. I hope that when all of the CE3s get reinstated that YOU must remain an RTSS. That would be JUSTICE!

MESSAGE FROM BILL NUTTY

ATTENTION ALL HANDS!

TRAGEDY AT SEA.

A CE DECK HAND HAS BEEN LOST.

Something terrible has happened aboard the SEA-E-3 during our test run at Cherry Grove, Fire Island.

Well, here's what happened. Everybody was having so much fun. Chris Walrus was drunk off her ass dancing in a string bikini up in the lookout tower (what a sight). I was having a sword fight with one of my new Security CEs (which I now affectionately call Bill’s Brutes). Oh yea Mr. Cheatem was throwing up over the side again, which I just didn't understand. The water was so calm. Could it be my lifestyle? Don’t ask don’t tell.

Well, anyway all of sudden one of my "Brutes" informed me that a Deck Hand CE was handing out IBEW union cards and talking union shit. I said, "This is equal to mutiny. Go get him, my Brutes".

When Bill’s Brutes brought him, he threw his clogs at me and told me to stick them up my you know what. Then he jumped overboard and started swimming towards land. All the weekenders at Cherry Grove dove in to rescue him but the CE Deck Hand started swimming in the opposite direction, screaming, "Leave me alone. I am no longer a Girly Man CE Deck Hand. I grew my balls back. I'M VOTING THE UNION IN".

With that Mr. Cheatem took control of my yacht and “accidentally” ran him over with the engine props trying to “save him”. Then Mr. Cheats said, "Now THAT”S what I call a CE pay cut. I feel so much better".

It was so tragic. Thankfully nothing happened to me. Chris Walrus was so wasted she never noticed anything. Mr. Cheatem stopped puking. But most importantly the rest of the CE crew just kept kissing my ass and working like nothing happened. They threw all their union cards overboard like the good little girly men that they are.

Everything always just works out for my rich greedy ass.

As always HA RRAY for me and FUCK YOU.

Union-Busting Confidential:

Cost to Thwart Unionization: $2.7 million - CHA-CHING
Cost of NLRB Union-Busting Fines: $7.75 million - CHA-CHING

Article Excerpt:
If such examples were intended to sell us on the idea of hiring legal experts, the irony is that Jackson Lewis has advised companies that have sometimes gotten into serious legal trouble. In the case of EnerSys, a South Carolina battery plant that retained Jackson Lewis at a cost of $2.7 million to thwart unionization, things got so bad that the NLRB eventually filed a complaint against EnerSys, accusing it of 120 violations of labor law, leading to a $7.75 million settlement with federal officials. EnerSys, for its part, would subsequently sue Jackson Lewis for engaging in what it termed “a relentless and unlawful campaign to oust the union.” (EnerSys was apparently astonished to learn that the union-busting firm they’d hired had engaged in union-busting.) Jackson Lewis forcefully denied that it advised or engaged in wrongdoing. The case was recently settled under confidential terms.

I've been astounded at the lack of knowledge displayed in this so-called forum. To think that some of these comments came from actual NCR CE's is absolutely astounding and shows just how infantile some of these people are. The thoughts written here are crude and malicious, misspelled, hollow epithets that show the writers lack of grace and education. If this is supposed to convince me of the merits of joining organized labor, then count me out. Unless, the truth is that New York is a truly undesirable place filled with hollow egos, loud mouths and people hiding behind a real lack of sophistication.

I expected better of you people, but the discourse here just goes to prove that the "big city" along the Hudson is just full of "big mouths". Touting threats and warnings is not a good way of persuading people to join cause you consider just and good. It just makes people nervous and think about what you are asking them to do.

This wild-west mentality is extremely counter-productive, as evidenced by the countless requests to "send in those cards", and the lack of response to those requests. How many cards have really been returned throughout this whole time? Has any of your Union "Brothers" let you in on how close you are? Do you have any idea of where you actually stand in your organizational endeavor? Most likely not.

You really do have a noble cause; NCR has put itself in what could be a bad position. But based on what I see here, theres no-one bright enough to make the dream you have happen, and thats a real shame.

Un-American: Employers’ Dirty Tricks at the Workplace

by James Parks, Sep 24, 2007 from AFL-CIO Weblog

Polls show most Americans are unaware of the extent to which some employers will go to stop workers from exercising their freedom to form a union. But a chilling new article, by journalist Art Levine, exposes the dirty details of these often sinister actions.

In the October issue of In These Times, Levine gives us a blow-by-blow account of a seminar he attended in Las Vegas led by two attorneys from Jackson Lewis, one of the major law firms in the field of union-busting. Union-busting—the so-called “union avoidance” industry—is a multibillion-dollar industry involving more than 2,500 lawyers.

In “Unionbusting Confidential,” Levine exposes the techniques these lawyers teach their clients to keep unions out of their workplace. The first suggestion to employers: Act respectful of workers’ concerns to prevent union sympathies from growing. They even suggest writing out—but not adhering to—a mission statement that includes treating workers with dignity.

The lawyers then give seminar participants a litany of tricks to derail the efforts of their workers to do what the law says they have a right to do: join together to form a union and bargain for a better life. The Jackson Lewis lawyers encourage the employers to be proactive, to take a leading role in denying their workers their freedom to form a union.

Here are just a few of the comments of what the lawyers told Levine and the other seminar participants:

* If a supervisor sympathizes with the workers who want to form a union, one of the lawyers jerks his tie upward against his neck to suggest a hanging.
* Tell employees stories about other workers in a union going on strike and losing their jobs to replacements because “It’s lawful. What happens if this statement is a lie? They didn’t have another strike, there were no replacements? It’s still lawful: The labor board doesn’t really care if people are lying.”
* Firing workers for seeking to form a union is illegal under current labor law, so Jackson-Lewis encourages employers to make sure they fire union supporters for other reasons.

Levine also shows that these actions have human consequences. They hurt families and communities. He cites the story of Bill Lawhorn, who was fired the day after he and his fellow workers narrowly lost an election to join a union and bargain for better wages and working conditions. Five years later he is still without a steady job.

Lawhorn, 51, worked 12 years at the Consolidated Biscuit Co. in McComb, Ohio, before he was fired:

“It’s always right there in my mind,” Lawhorn says. “My children thought I got really mean, and I did for that first year.” Back then, everyday, after a fruitless search for a new job, he would drink beer heavily. “I’m definitely a victim of union-busters,” he says. “They’re the ones who told [company officials] what to do.”

Click here to read more and watch videos of Lawhorn telling his story.

It appears many employers are taking similar advice. Consider the findings of Cornell University scholar Kate Bronfenbrenner, who studied hundreds of organizing campaigns:

* Ninety-two percent of private-sector employers, when faced with employees who want to join together in a union, force employees to attend closed-door meetings to hear anti-union propaganda; 80 percent require supervisors to attend training sessions on attacking unions; and 78 percent require that supervisors deliver anti-union messages to workers they oversee.
* Seventy-five percent hire outside consultants to run anti-union campaigns, often based on mass psychology and distorting the law.
* Half of employers threaten to shut down partially or totally if employees join together in a union.
* In 25 percent of organizing campaigns, private-sector employers illegally fire workers because they want to form a union.
* Even after workers successfully form a union, in one-third of the instances, employers do not negotiate a contract.

Working people are determined to put workers’ freedom to join a union on the front burner of the 2008 elections. The union movement is backing the Employee Free Choice Act, which passed the House in March. Although a majority of senators supported the bill as well, supporters were unable to cut off debate and bring the bill to a vote. If passed, the Employee Free Choice Act would allow workers to freely form a union without employer interference.

And that is something that is sorely needed, Lawhorn says. He tells In These Times, he has lost faith in the government officials who should have protected him.

I expected them to do what they’re supposed to do. This is my right, a federal right to form a union. All the company had to do [to avoid complying] was…nothing. It’s un-American.

How Do You Drive Out a Union? South Carolina Factory Provides a Textbook Case
By STEVEN GREENHOUSE

UMTER, S.C. - Tom Brown, the leader of an anti-union campaign at the EnerSys battery factory here, made some surprising admissions in recent testimony about how his campaign had been run and financed.

Mr. Brown, a longtime maintenance man, acknowledged that a mysterious consultant known as Mr. X had advised him on how to oust the union and had helped him write fliers that called the union's leaders names like "trailer trash," "Uncle Tom" and "dog woman." Not only that, Mr. Brown testified that envelopes filled with cash had often been sent to his home. He said he had no idea who had sent them. "I don't look a gift horse in the mouth," he said.

Across the South companies have long used bare-knuckled tactics to fight unions. But now a surprisingly detailed roadmap to such tactics has emerged from an unusual court battle between EnerSys and its law firm over whose wrongdoing - the company's or its lawyers' - led to a $7.75 million settlement that EnerSys entered into after federal officials accused it of 120 labor law violations in its seven-year effort to eliminate the union.

The company has accused the firm, Jackson Lewis, of malpractice and of advising it to engage in illegal behavior. The law firm says that EnerSys ignored its sound advice and that the company is trying to avoid paying its legal bill.

The wrangling has cast a spotlight on how the company fired and harassed the union's top officials and aided Mr. Brown, the anti-union leader, although federal law prohibits companies from financing or otherwise assisting efforts to get rid of a union.

The litigation also highlights a little known but thriving business in which law firms and consultants work with corporations to beat back unionization efforts. Jackson Lewis, a national law firm based in New York, describes itself as "committed to the practice of preventive labor relations."

"Union membership is declining because employers will stop at nothing to prevent employees from having a union," said David Bonior, the former Michigan Congressman who is now president of American Rights at Work, an advocacy group fighting violations of workers' rights. "Unfortunately, 75 percent of employers use union-busting consultants to fight unionization drives."

Labor experts call the EnerSys case unusual, with federal labor officials accusing the company of firing the top seven union leaders, spying on workers, refusing to bargain and ultimately closing the 500-worker plant to retaliate against the union. Its $7.75 million settlement is evidence of how far the company strayed from the law. But labor experts also say the case opens a window onto some common tactics.

"Jackson Lewis is a key player in the union avoidance industry," said Fred Feinstein, former general counsel at the National Labor Relations Board. "This kind of aggressive anti-union campaign is not unusual."

Jackson Lewis says it did nothing wrong.

"Jackson Lewis zealously represents its clients," Kevin A. Hall, a lawyer representing the firm, said. "In doing so, the firm always honors the letter and the spirit of the law. Jackson Lewis was neither involved in the initial campaign by the union to organize the employees nor involved in any effort to assist the employees to oust the union." EnerSys refused to comment.

This tale began a decade ago when the International Union of Electrical Workers began rounding up support at the factory, which produced giant batteries to power forklifts and provide backup power to cellphone towers.

The union petitioned for a unionization election when many workers voiced dismay about meager pensions, bullying supervisors, production speedups and safety problems, especially with the high temperatures and lead used in production.

The company, then called Yuasa, hired Jackson Lewis to help mount a last-minute anti-union campaign. The company required employees to listen to speakers saying the union did not want to help workers, but only wanted their dues money. Management posted pictures of tombstones and skulls and crossbones in the cafeteria to warn employees that unionized factories often closed.

But on Feb. 23, 1995, the workers voted 191 to 185 to unionize. Management was livid.

"They said that if the union came in the company was doomed," Paulette Jackson, a union steward and quality control worker, said. "They fought tooth and nail. They didn't want a union in the South. Period."

The company fired Ms. Jackson, accusing her of failing to detect some faulty batteries, but her supervisor later told the National Labor Relations Board that the charges were trumped up.

The company's tactics led to many tangles with the labor board, which ultimately filed a sweeping complaint against EnerSys, accusing it of 120 violations of federal law, among them wrongly firing Ms. Jackson and other union leaders, assisting the anti-union campaign, improperly withdrawing union recognition and moving production to nonunion plants as retaliation.

As a result of all the litigation - including the battle between the company and its lawyers - detail after detail of what had happened emerged. In a deposition, Darryl Davids, the factory's director of human resources, testified that John Craig, the company's president, had once said: "We need to do whatever we've got to do to get rid of this union, regardless of what it may cost us."

There was an RTSS in the 106 region, he came over from AT&T (with our Regional Director)he had been a Supervisor (lowest level management employee) his job was to support & train CEs. Some of you have been in his classes such as the APTRA class he taught in the warehouse. He never ran service calls because was not in the Union (it would violate our contract) He retired a year or so ago, I don't think he was replaced. A few years ago I asked him what he would do in the event of a strike.
He said he would do what he had always done, "Support & train" just like level 2 or instructors would do. He would not run calls, he had personal integrity.
As a new RTSS your moment of truth may be just ahead of you, please consider your role in the coming events.
I would also point out that several CEs have been promoted to TMs in our region.

I don't mean to get off on a rant here but Unions? OK. You want a union? That means you want union dues coming out of your already meager check and there is no guarantee that your union lawyers will even be that good. Unions are good but they are also used to speak for you. Wouldn't you rather speak for yourself than have a lawyer do it? Can't you speak for yourself? I got a call from an "anonymous" person today who told me that alot of the organizers for this so called "union" are a bunch of old and disgruntled techs who have been here since before Jesus was around. You want to change the system? Get yourself into the system and change it within. Make it your lifes mission to put yourself where NCR needs to itch every now and then. Once you get yourself in, then get others like you in. NCR is a worldwide corporation which means they are just like all the others. Too big to care much about anything else other than getting bigger and richer and leaving you in the dust. For those of you who are still young, go to another company who will pay you more money to do what you do here. If you find a company like that, let me know. For you atm guys. Don't go to diebold. They start at a smaller pay per hour for thier CE2 technicians than NCR does. For those of you complaining, I suggest one of two things. Become part of the system to change it within or go look for another job that pays you more and treats you better. I am here because I choose to be here. If I get fed up, I will speak my piece and quit for better and brighter pastures. This union thing though? Sure. Get one of those and see your checks get even smaller. Most of you would agree that the mouths of your children are more important than the mouths of your union. I wouldn't attempt a strike either. NCR will put a bunch of old temp contractors in your place for much less than they are paying you until you decide you want to come back to work. That is if you have a job once you come back. In this day in age, I am happy to have a job in the career I chose. I got here with no degree and minimal certifications. Do you think another company is going to overlook that fact that some of you may not have 5 years of school and a computer science degree under your belt? Most want those degrees. Do you think another company is going to give you the $20,000 dollar per year equivalent to technical school that you get for free at NCR? Some tech schools charge more than that and they could care less whether you pass or fail as long as they get paid. I just came out of school at NCR and my instructor made damn sure I knew what he was teaching me. You can't outsource an atm tech. you can't outsource a retail tech. Believe me. If Wal-Mart was talking to our guys in india on how to replace or repair something, they would never renew their contract with NCR. NCR isn't perfect but at least they care enough to make sure I know what the hell I am doing out there because losing a contract means losing revenue. Of course thats just my opinion. I could be wrong.

Anonymous said...

Let me tell you guys one thing and one thing only. If you can't speak up for yourselves then put up and shutup. Don't ruin life for those who like things the way they are. This union thing should be for those who want to be part of it but don't shove it down my throat. Your complaints may affect the food that goes into my sons stomach or the roof over his head. Go find another friggin job.

To the guy that said that he go anonymous phone call condenming the union was a union buster. Be a man and contact Chris Cheadle and tell him about your phone call. It sounds like this guy calling you is wasting company resource. Chris should send out a letter to all non union CES stating from his own book of Ethics like he did to us UNION CEs in NY. But you wont. You would rather spew the Company bull that you fell for!

TO THE BRAINIAC THAT SAID GO FIND ANOTHER FIGEN JOB....

Well let me tell you. Continue to do what you do and I will continue to do what We do here in the union. The CEs here in the NY/NJ area are the best thing to happen to this company. They keep shoveling the shit and we continue to clean it up. Why you ask? Because thats what we are paid to do. And we do it well. You go back to your meeger existance and do what you do for less!! We wont stand for it. You make it sound like we should and could change things around here by getting promoted. Like there are jobs for all of us.

One more thing. You say that we will take food out of you kids belly... Think again.. Thats the company. We didnt lower your pay..NCR DID! If you were a member of my union before all this happened, you would not be in the position that so many of you are in. It sounds like you dont mind settling for less. I cant and I wont. Not without a fight to the very end.

One last question. Would you allow some one just take money out of you pocket? Well that what NCR just did.

SO GO STICK YOUR HEAD IN THE SAND. TURN YOUR CHEEK ON YOUR COWORKERS.

YOU ARE NOT WELCOME IN MY UNION.

ALL OF YOU WHO ARE INTERESTED, PLEASE SIGN THOSE CARDS ARD JOIN THE Union. YOU WILL NOT REGRET IT. THE DUES EQUATE TO ONE HALF HOURS PAY PLUS 1 DOLLAR. THATS A BARGAIN.

I would like to address those who took my call as a shot. I never would consider this drive as just bunches of old guys that are pissed off nor did I say this to you. I invited you to this site and for a chance for your voice to be heard. Well, we now know where you stand. I take it that you are somewhat new being that you just came back from Dayton. You think that you have learned it all from your instructor? Guess again. Your real training comes in the field, but I guess you know it all now.
You both seem to think your job is assured. I take it that you didn’t stop and read the blog about outsourcing in areas like in Canada. Many CE’s such as you have been replaced by scab labor at the detriment of quality and years of knowledge. I guess since you have been to school, you know it all now and you’re not replaceable.
I invited you brother to brother, to speak intelligently about the direction and quality of service this company lacks. In the past, CE’s “bet their jobs” in schooling that eclipses what you called atm tech school in Dayton. By your post, you are a looser and you are ok with this. I am not going to cram anything down your throat. I don’t need to. You are choking on your own lack of understanding of the facts. NCR has sold out the CE3s and you are next, but you’re too stupid to see it.
It was sure nice talking to you.

I just got off the phone with a fellow union co-worker who is in Dayton training. He stated he is being treated like and outcast. His classmates are talking out loud says this like.."dont worry, we will all be at the same level in a couple of months" and "we are here to get training on the equipment in NY so when the company throws the union out, we could fill in". Lets make one thing perfectly clear. We will nor sit back and let you come in here and take our jobs from us!!! Please read between the lines. Take if for what it is worth. Call it what you want. It's not in your best interest to come here and help the company. There is nothing the company promise you to make your trip worth it.

I came from another company that went bankrupt. I used to make $21 an hour. I started at FLT for $13. We joined the Teamsters and got a got a whopping 50 cent increase. I was transferred over to NCR and out of the Union. NCR gave me another 43 Cents. After three and a half years I am now at $15 and change. What will the new Union do for me? I am a retail Tech and I am on call every other week. I work an average of 65 hours during my on call week. I have had two days off on a weekend since the begining of the year. I am approaching burnout. We are understaffed and overworked. I want to know if there are ongoing negotiations between NY and NCR? Will my pay go up? It is going to get very interesting around here very soon. I am holding on till this is over on way or the other. If things don't change for the better, I am out of here.

Why do you think Upper management waited to pull this FLS crap "again" only after the new Wal-Mart contract was signed?
I am sure if they knew that only one guy with no parts, no company van and no clue would be running 18 stores, they would have had some questions about this contract.
"Take the money and run" say's Nuti
But once again they are trying this "again". Didn't we go through this once before with FLS and the store visits?

The worst part is they think I going to train the FLS guy so they can go ahead and reduce more headcount. The Working man is not stupid just tired.

Personally he seem ok, but no matter how much I can show him, he will quit anyway, so why bother. Soon, Wal-mart will complain and we will be back doing the visits again. The CSM's will be pissed off and it will be time to "fix the customer" "again".
One more chance to practice those customer facing skills.
NCR, you guys suck at management.

NCR HAS PROVEN ONCE AGAIN THAT THE ARE MAKING A BOAT LOAD OF MONEY ON OUR BACKS. REMEMBER WHAT NCR HAS DONE TO THE CE3s. THEY ARE NOW TRAINING CE1s TO DO CE2 WORK. THE NEXT MOVE IS TO REDUCE CE2 PAY TO THE POINT THAT YOU WILL QUIT AND OUTSOURCE THE REST OF US. LOOK AT THE PERSON TO YOUR RIGHT, NOW LOOK AT THE PERSON TO YOU LEFT. ONE OF THEM WILL NOT BE HERE BECAUSE HE WILL QUIT. THE OTHER WILL BE OUTSOURCED. LEAVING YOU OUT IN THE COLD.

THE ONLY THING THAT WILL HELP US IS GETTING THIS UNION UP AND RUNNING...

All FLT guys are not dopes. I work with one who has been in the company 30 some years. He has told me stories about the last time NY went on strike. A Scab got a visit at his hotel room. They knew his name and his wife and kids names also. He left town the next day. We finally recieved a phone call from someone looking to get cards signed. They are being supplied with a list of phone numbers. This is in the Philadelphia area if any spys on here would like to know. It is spreading. Go union.

Territory manager in the North East said…
Good morning all. In my own opinion, It would be in your best business to get the union onboard or at least voted in before the boys in NYC go to the table. The company has an agenda, and that agenda is to jam the new paycuts down their throats. They are paying big money to the union busting lawyers, they have us managers ready to go, and most RTSSs on board. The ones that are on board seem to have a lot of concerns about crossing the picket lines if there is a strike. No one want to leave home for any length of time. There also fear for their well being.

If you want to prevent a massacre, you guys must sign up now and show the company that they have more than NYC to worry about and they might back down.

I get this feeling that the company is using this as a tactic to lower the pay across the board and then they won’t care if a union is voated in. They would rather have a starting pay that is 400 buck a week lower and have the next regime negotiate up from there. It will show the share holders a larger profit and Bill should get a large going away package when his time is up. Then leave the union to someone else. I call it the Cheadle twist. Look what happened in Australia. Hit was a hit and run.

I am writing you because in my heart, I feel for you. This could have been me few years ago. That is when I became a Manager. I was in rework in NJ, Then they closed up shop. I became an FE servicing ATMs and proof. Then I was a group leader in a union office and moved out to another office doing some proof, atms and cisco. Now I am a TM and I must say I hate it but I have no other options.

I don’t know what else to tell you people. Its going to be real tough. The company does not tell us much, but what they do say is they have it all figured out. Typical of this company.

I am not sure if things will work out if the rest of the company does not have a vote in place. But in my heart i do feel that if one or two offices has a successful vote then it will be a lot easier to tame this company. What I will tell you is , out FOD and AFOD are very concerned about getting the work done if there is a strike. They feel that the TEAMSTER will not sit back and allow this latest round of insult hurt their members. I have heard that they have gone to Dayton and pleaded for this not to happened.

The rest of the country must stand together and help the cause. Do it before it too late. The New Yorkers will do their part and the rest of you must do you part. It can’t hurt you. Remember, I was in the union and Let me tell you that it breaks my heart to do what I do day in and day out and it would not happen if my crew were in the union.

In this day and age, you guys need protection from corporate America. I can’t understand how the think they can get away with this. You must push back. This, In my own opinion, is the start of a workers revolution. People can not sit back and allow big companies do this. It will be the cause of the next great depression.

I am going to step off my soapbox now. You people have the perfect opportunity to do something right for yourselves. The union was good for this company in NYC for so long and now its no good? Bullshit. The union always worked with the company. As a matter of fact, the company always paid the non union offices better for the longest time, but the union stood strong. It wasnt alway about the money. It was about the whole picture. And now look who is suffering. And The company will try and force this crap on NYC. If you all stand strand, and what I mean about that is, Join the union, the company will have to stand down. They can not conduct business with everyone on strike!

I feel for all of you. I was on the other side myself. I wish you all the luck and god speed.

GO UNION NOW!!

One last thing. All of you who read this. Please know that I am a TM and I wish I can go public. I am a god fearing christian and I would not lie. I believe in your cause and feel that I am on the wrong side of this fight. I need a paycheck. You also need a bigger paycheck. I dont carry a toolbag anymore but please know where my heart is. I have been asked to go to NY but let it be known my head and heart wont be in it! Those who know me, will know wrote this. I will deny it. I hope my guys go union. Thet deserve it. They are a great bunch of guys. All of you are a great bunch of guys. You deserve better.

Those of you who wish this drive to work you MUST get on the phone and start talking to our brothers in the field.
In my calling, I found a whole bunch of people don't know about this drive.
If your looking about more cards and support for this union, ask yourself what you can do to make this happen?
I use my own phone, got a list from a friend who is already in the union and started calling.
I don't ask for their thoughts or look to pin anyone down, I just invite them to this site and to make their own minds.
Our phones are our guns and our mouths is the ammo. Start Shooting.

What else can I do? My card is in and my area is onboard. I still have to work everyday. When you say you guys. I am not on the fence. I am pro union and support "YOUR" cause. I wish we were all union but thats not the way it is. I haven't been here for 25 plus years and didn't have a say in a vote when NY went union. I don't know why the rest of the country didn't follow. Thats water under the bridge.
If you spout off like your DA MAN and no one can F&^% with you that hurts me and the ones trying to change the minds of people on the fence.
I understand your frustration and I want you all to succeed however if the country goes union prior to your (NY/NJ) walkout you my friend have more POWER as a group. That should make you want to help us get the fence sitters moving in our direction. If that doesn't happen it will be a long process for you as a group and you may have to eat those paycuts ect... just like we did.

If you have everyone onboard and all your cards are in.. You must get the the union board and vote. Now is not the time to sit back and wait. NY is going into contract and if we can get another office online we will have the company on the ropes!!! they can not fight a 2 front war. And once youre online, the others will follow suit. We can save our jobs and just maybe make things better for all CE1s & CE2s alike. I am talking better pay, cheaper medical cost, downtime, no work on consecutive weekend days and all around greater treatment by the company.

Please contact your union rep as soon as possible. Good Luck

SAY NO TO OUTSOURCING..THAT IS WHAT IS NEXT ON THE COMPANY'S AGENDA. CE1 AND CE2 ALIKE WILL BE LEFT OUT TO DRIVE. IF WE DONT GET THE UNION VOTED IN, WE WILL ALL BE OUT OF A JOB. WORKING FOR NEXT TO NOTHING. WITH NO HEALTH INSURANCE AND WITH NOWAY TO PAY THE BILLS..ENOUGH SAID!

Please answer these questions. Are there ongoing talks between NY and NCR? When is your contract up? Will you work without a contract in place if talks continue? By the way the Teamsters still left at FLT in NJ and PA have a no sympathy strike clause in their contract. Don't let NCR slip this into your deal if you get one.

To the RTSS who are forced to come to NY/NJ in this summer:
We hope you can get some execuses not to come. If you come we hope you are coming to help CE in NY/NJ not NCR. It can be done very easy : "SLOW DOWN".
It is a undisputable fact that anybody will be not able to function in a total strange place in very begining. We just hope you make this naturally slow down period little bit LOOOOOONGER.There is no GPS on you. You just get lost and could not find the site. Even you finally get to the site. The people in Banks, supermarkets, Starbuk Coffee.... do not know you. It will take a litttle bit LOOOOONGER time for them to verify that you a legit person and let you touch the machine. Beside you need security escort to many sites for safty reasons in NY/NJ. It takes hours sometimes. I am not trying to scare you but in many places in NJ/NY even policemen do not want to go in along.Do not forget
Your well being is the top priority.
Your showing up in NY/NJ will satify your TM and you will not be punished by NCR fot not coming to NY/NJ. But SLOW DOWN is your weapon to get even for all the misery you have suffered from NCR so far and meanwhile all the CE in NY/NJ will be very very appreciated to your help of SLOW DOWN. Please help. IF we win. Good things will happen to all CE and RTSS in NCR.
Again, If you come , you are coming to help to change the NCR back to the right path.
Do not pay attention to the posted warn or threaten messages. They might be written by the managers who try to undermine the Union of NY/NJ. But it may serve you a good reason to not come. You can show those kind messages to your TM and ask gurantee of your safty " in writting" and even more compensation for this possible dangerous task.

maybe this will help...we have a bunch of questions asking what kind of union contract the Teamsters got the last time around. And our answer is we really do not know all the specifics. I can tell that the got a payraise while our pay was cut..The get 8 hours downtime after working any 12 in a 24 hour period. they still have personal use vechicles. top pay for ce3 is $31+ an hour..top ce2 pay is $800+ and top ce1 is almost $700. avail pay is 165.00. No consecutive weekend days. Must be notified 2 weeks in advance for a shift change. There is more but I remember it all. This id due all to their union. We can fight for the same or even better. Its all poosible if we band together and get as many offices online as quickly as possible. Get those cards sent in. You have nothing to lose. We dont start paying dues if we don't get an equitable contract.

for year the ncr ceo's have been raping the company. from jerry, lars, mike and now its bill. and in all the yes of pilige the company was losing money and they still big money and then was given a huge golden parachute. and thru all that time we were told that there was no money for raises the bonus was lean. ok..i understand we were losing money...

But now we have had 2 record breaking years. and a successful spin off of terradata which ncr had carried for many years at a loss. bill has picked up where the others left off with a tremendous bonus and paycheck. he also gets to throw his contract out the window. now that ncr is doing very well, how does ncr repay us. they lower pay and screw us with the bonus. i could understand this we we were operating at a loss by whats thier excuse now???

good people, please stand up for all that is right. you deserve to be treated with respect. all we want is a decent wage. we were not making an insane amount of pay. by some standards it sucked!! now they want their cake and eat it to!!! why not us. because we dont come with a business school degree.

we are all share holders in this same company. we have rights also. with a union, we have the ability to help return us to where we should be. lets not let this slip through our fingers. Please talk to your co-worker and ask them if they are aware of this movement? ask them if the sent their cards in. if they need cards they can call their local ibew office or even ask here. please do not let this fall apart. the constitution say we have the right to representation. the company have high powered, hi paid lawyers. well so does the union.

NY Times.com:

Murder in New York: Killers and Their Victims in the Five Boroughs

Between 2003 and 2005, 1,662 murders were committed in New York. Men and boys were responsible for 93 percent of the murders; their victims tended to be other men and boys; and in more than half the cases, the killer and victim knew each other.

In addition, an interesting, though uncommon, group of murders involved a handful of victims who died of injuries one or more years after being stabbed, shot, beaten or burned and were counted as murder victims in the year in which they died. HEY GUYS..JUST VOTE IN A UNION AND THE COMPANY WILL GIVE NEW YORK A CONTRACT THEY CAN LIVE WITH AND WE WON'T HAVE TO GO TO NEW YORK. THEN WE CAN GET A CONTRACT WE COULD LIVE WITH..MAYBE SOMETHING LIKE THIS...THIS WAS WRITTEN EARLIER..

maybe this will help...we have a bunch of questions asking what kind of union contract the Teamsters got the last time around. And our answer is we really do not know all the specifics. I can tell that the got a payraise while our pay was cut..They get 8 hours downtime after working any 12 in a 24 hour period. they still have personal use vechicles. top pay for ce3 is $31+ an hour..top ce2 pay is $800+ and top ce1 is almost $700. avail pay is 165.00. No consecutive weekend days. Must be notified 2 weeks in advance for a shift change. There is more but I can't remember it all. This is due all to their union. We can fight for the same or even better. Its all poosible if we band together and get as many offices online as quickly as possible. Get those cards sent in. You have nothing to lose. We dont start paying dues if we don't get an equitable contract.

Dear Chris Cheadle,
Your letter to the NYCEs indicated that NCR would not tolerate threats against Scabs. Fair Enough!
How would YOU like it if NCR reduced YOUR Salary by 30% & shipped YOUR ASS to NYC this Summer?

for year the ncr ceo's have been raping the company. from jerry, lars, mike and now its bill. and in all the years of pilage the company was losing money and they still made big money and then was given a huge golden parachute. thru all that time, we were told that there was no money for raises and the bonus was lean. ok..i could understand, we were losing money...

But now we have had 2 record breaking years. and a successful spin off of terradata which ncr had carried for many years at a loss. bill has picked up where the others have left off with a tremendous bonus and paycheck. he also gets to throw his contract out the window. now that ncr is doing very well, how does ncr repay us. they lower pay and screw us with the bonus. i could understand this we we were operating at a loss, but what's thier excuse now???

good people, please stand up for all that is right. you deserve to be treated with respect. all we want is a decent wage. we were not making an insane amount of pay. by some standards our pay sucks!! now they want their cake and eat it too!!! why not us. because we dont come with a business school degree.

we are all share holders in this same company. we have rights also. with a union, we have the ability to help return us to where we should be. lets not let this slip through our fingers. Please talk to your co-workera and ask them if they are aware of this movement? ask them if the sent their cards in. if they need cards they can call their local ibew office or even ask here. please do not let this fall apart. the constitution say we have the right to representation. the company have high powered, hi paid lawyers. well so does the union.

I THOUUGT THIS NEEDED TO BE RE-STATED. COME ON ALL, WE NEED THE UNION

I have never been in a Union, BUT I think the time has come to change that.... however I have many questions about the details?

I see references to NY/NJ and Teamsters.. Are The Teamsters and IBEW the same.. affiliated.. ??

Why is IBEW the best Union for NCR CEs to join..
No disrespect intended.. I thank them for their interest in our problem... I am just curious if there are multiple organizational efforts in progress or is this "the one that best fits our needs?" or if this is the one we have been directed to by job description

What is the actual out of pocket cost to be a union member? Monthly dues

Does signing a card (I have not seen one yet) make me a member or does it just indicate that I am requesting a vote of the other employees to go Union or not?

How would the decision to become Union be determined... Obviously we have a small segment that is currently Union... but the rest are not. Will it be voted on by State, region, City, workgroup???

HI THERE, THE VOTING SHOULD BE DONE AT YOUR LOCAL LEVEL. YOU WILL NOT PAY DUE UNLESS A CONTRACT IS VOTED ON. USUALLY 1/2 HOURS PAY PER WEEK. iF YOU NEED A CARD. WE NEED TO KNOW WHAT REGION YOU ARE IN SO WE CAN GIVE YOU A NUMBER TO CONTACT. OR GOT TO THE IBEW WEBSITE AND GET A CONTACT NAME AND NUMBER.

I THINK THE IBEW IS ONE OF THE LARGEST UNION AND THEY ARE IN THE TELECOM/ELECTRICAL INDUSTRY. THEY HAVE THE BEST UNDERSTANDING OF THE NEEDS OF THE BUSINESS.

I HOPE THIS ANSWERS SOME OF YOUR QUESTIONS

NEW ENGLAND, NEW ENGLAND, (tisk, tisk)

What ever happenned to "live free of die", give me liberty or give me death", "the Cheat-les are coming", no taxation without representation"?

NCR gives Taxation, Unions give Representation. DDDAAAAA!

If you are truely just 12 cards short of filing with the NLRB, then you know exactly who hasn't sent their cards in. Why not individually convince these people of the merits of holding an election? (they can always vote NO on their "secret ballot") Cheat-le is a Callous Prick who would deprive his own children of a decent allowance to save money! (he still has his "First Communion" money)

It would surely give us something new to talk about here and cause NCR to "shit their draws." Cheat-le needs to come down a few pegs and learn how to deal with us as equals. New England started a Revolution for less! If you can't draw Cheat-le and the IBEW out in the open to seriously debate the issues, we will never know the truth!

EnerSys, a South Carolina battery plant that retained Jackson Lewis at a cost of $2.7 million to thwart unionization, things got so bad that the NLRB eventually filed a complaint against EnerSys, accusing it of 120 violations of labor law, leading to a $7.75 million settlement with federal officials.

WOW...IT LOOKS LIKE THE LAWYERS NEED A LAWYER...TO FUNNY

This is typical NCR. Rather than rewarding the guys for a job well done, they would rather beat the guys down...With a little luck it will backfire and they would have wasted more monies which could have been used fot the good of the guys....

To whoever wrote:

"IF CEs CAN'T FIGURE OUT HOW TO JOIN A UNION,

I think your being a little unfair. When the union started back then everybody met in an office (the shop) before they ran calls. So there was instant unity. Every morning and throughout the day when guys would come back and get parts you could have union talk. Now everybody is virtual and they feel alone and scared. They will come around it's just taking some extra time.

Anonymous said...

Another reason is back then the guys had "bet your job Friday". If they failed a test in Dayton you were fired and sent back to NY. You had to have a big pair balls to take a job like that.

Now they have you "better have no balls Friday". Bill Nutty personally goes around and does an inspection to make sure the new guys did not grow any balls. If they did their fired and sent home.

WOW! THANKS FOR THE HISTORY LESSON.

STILL, ALL CEs MUST REALIZE THAT SIGNING A CARD ISN'T JOINING THE UNION -
IT IS JUST ASKING FOR A VOTE OF CONFIDENCE - NCR OR IBEW.

IF YOU DON'T WANT THE UNION, YOU BETTER SPEAK UP!
IF YOU WANT THE UNION YOU BETTER NOT SHUT UP!
MAYBE NCR BEGINS TO HEAR THE TRUTH ABOUT WHAT THEY DID TO THE CEs?

IF I LOST 30%, I WOULD IMMEDIATELY SIGN THE CARD! NCR's NEW POSITION
IS WORSE THAN "BET YOUR JOB - FRIDAY". IT IS: "LOSE YOUR JOB - EVERYDAY"

DOING THE SAME WORK FOR 30% LESS IS LIKE HAVING A DIFFERENT JOB.
ADD TO THAT THE LOSS OF HEALTHCARE, FROZEN PENSION, INCREASED TAXES,
DEGRADING ATTITUDE TOWARDS CEs BY CT, PA, TM, AND NCR CORP.

AS DAFFY DUCK SAYS: DESPICABLE!

Anonymous said...

Wait a minute..I still do the same job for 25% less. I do the same work that a newly hired ce2 does. so he must be underpaid right from the start. And now this company is forcing ce1's to pick up tools and do ce2 work. The writing is on the wall people..I smell a rat.

The next step for the company is to demote all to ce1 pay. At that point they will hire an outsourcer. And tell us if we want to continue to work we must go to work for the outsourcer. for the same or less pay. and crappier benefits, if any.

Everybody must talk up this union and try to get everyone on the same page. We must get the union online as quickly as possible and start rebuilding our future.

Has anyone heard anout region 125?.. I heard they have enough to vote. Any word when they go to a vote?

Anonymous said...

Why are you doing the same job? I sure am not! I'm ordering more parts then ever, including more NFOs. More ATMs down over night then ever before. More PUP calls, PMCU calls are great, you can park in the shade and listen to the radio for an hour. Don't do the same job, just do the job.

Ripples Keep Spreading in a Chinese Bribery Case

SHANGHAI, Nov. 30 — Three multinational companies were named in a court verdict this month that sentenced the former head of China Construction Bank to 15 years in prison for accepting more than $500,000 in bribes, according to a copy of the court verdict.

I.B.M., NCR and Hitachi of Japan were named and identified as having worked through a Chinese middleman or consultant named Zou Jianhua in an effort to sell information technology services to the state-owned Chinese bank in 2003 and 2004.

The 20-page court verdict from the No. 1 Intermediate Court in Beijing said that while he was serving as the chairman of China Construction Bank, Zhang Enzhao met with senior managers from I.B.M. and NCR on multiple occasions with his longtime friend, Mr. Zou, who was acting as a middleman between the bank and several companies.

The court verdict said the middleman, Mr. Zou, collected large “service fees” from I.B.M. and NCR and that Mr. Zou later passed valuable gifts on to the bank chairman, including a massage chair, a pair of Tiffany watches and a luxury apartment in Shanghai worth about $330,000.

If American companies knowingly passed gifts or large payments to Chinese officials to win or influence business, they could be prosecuted in the United States under the Foreign Corrupt Practices Act of 1977. None of the companies named in the verdict have been charged with a crime.

The Department of Justice and the Securities and Exchange Commission are already looking into violations of the Foreign Corrupt Practices Act involving another American company, Fidelity Information Services, a software company based in Jacksonville, Fla., and China Construction Bank.

Some details in the verdict had been previously reported by Bloomberg News and the Chinese press, but the Beijing court records are closed to the public and even the companies named in the verdict have not been able to confirm the contents.

A copy of the verdict, which was obtained Thursday, clearly identifies all three companies.

In announcing the sentence against Mr. Zhang for accepting bribes, the Beijing verdict cited the testimony of former and current employees of I.B.M., NCR and Hitachi.

Mr. Zhang resigned from China Construction Bank in March 2005 after a lawsuit in the United States accused him of accepting a $1 million bribe from Fidelity.

I.B.M., NCR and Hitachi have all denied having knowledge of any bribes paid to Mr. Zhang. The three companies have released written statements saying they have not yet seen the court documents and are looking into the matter.

I.B.M. officials say China Construction Bank is a client and according to the court verdict, I.B.M. made a $225,000 payment to a Hong Kong company that Mr. Zou worked for from late 2003 to 2004.

The verdict said that Mr. Zhang recommended Hitachi for a contract, but that Hitachi did not win that particular contract.

Construction Bank officials declined to comment Thursday, beyond saying that Mr. Zhang resigned from the bank for “personal reasons.”

NCR said this month that Mr. Zou had a marketing-agent agreement with the company but was required to conduct business in a lawful manner. NCR, based in Ohio, said it no longer worked with Mr. Zou.

The case began in late 2004 when Grace and Digital Information Technology, a Beijing-based consulting company, filed a lawsuit in the United States against Fidelity, accusing the company of failing to pay Grace $58 million for helping secure a large software contract.

Grace executives charge that instead of fulfilling a software contract that dated to 2001 and was temporarily suspended in 2002, Fidelity switched to using Mr. Zou as its middleman. In the lawsuit, Grace accused Fidelity of paying bribes to Mr. Zhang through Mr. Zou.

Fidelity, a division of Fidelity National Financial, is not mentioned in the Beijing court verdict. Fidelity lawyers said in a statement that the court verdict “fully exonerates Fidelity and proves that Grace’s allegations are wrong.”

But in an earlier interview, lawyers for Fidelity said Mr. Zou had worked as a Fidelity consultant and that he had helped Fidelity secure a $14 million software deal with China Construction Bank. Fidelity’s lawyers say that they were introduced to Mr. Zou by I.B.M.

Fidelity also says that Mr. Zou was a consultant for a Hong Kong company called Prosten Technologies and that after Fidelity won its $14 million contract, Fidelity made a $1 million payment to Prosten.

Boies & Schiller, the law firm representing Fidelity, strongly disputes the allegations, saying the company did not violate its contract with Grace and never engaged in bribery.
